We truly care about your personal data (defined below), so we have prepared this Privacy Policy ("Privacy Policy") to explain how we collect and use it.

This Privacy Policy describes what personal data (defined below) we collect, how we use that data and your choices concerning our data practices.

This Privacy Policy forms part of our Terms and Conditions which is linked here. As this is an extension of Our Terms, any capitalised terms on this page may be defined in Our Terms linked above.

By providing us with your personal data when using the Services, you consent to the processing of your personal data as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access or use the Services.
Personal Data
When you visit, use or interact with our Service, including our Website or App(s), we collect information that, alone or in combination with other information, could be used to identify you ("Personal Data").

Personal Data you Provide Us:
When you join the newsletter, mailing list, sign up or create an Account ("Join"), you voluntarily provide us with certain Personal Data including some or all of the following: your name, email address, username, age, profile picture, time zone and language. If you register for an account through your social media account (including Facebook and Google Sign-in), we and you may see which of your friends are using the Services, and your friends may see that you have Joined the Service. The information we get from these accounts depends on your settings and the privacy policies of the social media platforms, so please check those policies to understand the privacy practices of those platforms.

When you register with Lingoswift, some of your information is made public and available at various locations, including on your public profile page. This will include the data from your profile and Account (Name, Username, Location, Bio, User ID, Profile picture and PRO Subscription status, courses & languages you are learning, XP points, people you follow and people who follow you on Lingoswift, your learning progress, streaks, Virtual Items on your Account). We will never deliberately display your email address, specific location or age. Information you post in comments, in the public forum, or other public sections of the Service will be displayed publicly and classed as public information. Third parties may be able to read, collect and use your public information for their own purposes.

If you pay for any Virtual Items on Our Service, you may provide us with payment information which may include your card details or PayPal email address. This information will be shared with our payment processor(s) to enable the transaction to complete. (Please see "Sharing and Disclosure" below).
We also collect information you choose to provide to us when you fill in any text boxes in our forms (for example, support request or survey submission). In addition, we may collect Personal Data disclosed by you on our forums, blogs and our other areas of the Services to which you can post information and content.

Automatic Data:
When you use this Service, we generate, collect and store various data which assists Us in trying to provide a great service, to improve our service, to keep users safe, to help keep your account safe, amoung other reasons.

This includes:
  • Login and logout records (including login attempts, IP address and location);
  • Session data including session time and duration;
  • URL data relating to our Website;
  • Push notification data (when you choose to enable these);
  • Notification activity including if notifications have been delivered, viewed or interacted with.
  • Text entered into text boxes;
How We Use Personal Data
We use Personal Data for the following reasons:
  • To authenticicate users and login attempts, process transactions and respond to your requests. This helps keep the Service secure, and is necessary to allow you to use the Service;
  • We analyze data such as session length and lessons participated in to improve our service by tailoring your learning experience and difficulty level to help you learn more effeciently;
  • To understand how visitors use the Service to help improve the experience;
  • To send you updates including necessary service updates (including password reset requests etc), account & course updates and reminders (such as lesson reminders), marketing offers or promotions. Where required by law, we will only send contact you if you have opted-in to receive such communications, or if the communications are necessary. We respect that you may not want to receive communications from us, and so you will be able to opt-out of or change your communication options;

If you ask us to delete your data or to be removed from our marketing lists and we are required to fulfil your request, we will keep basic data to identify you and prevent further unwanted processing.
Sharing and Third Parties
We take your data seriously. To aid in the effecient running of the Service, we may sometimes share some Personal Data with third parties.

  • Service Providers: We may sometime need to share some limited data with service providers such as payment processors (in order to process a transaction), hosting providers (where our Service is stored), analytic providers such as Google (to help us analyze website useage to help improve the Service. Opt-out here.), and customer support survices (for example when you contact us via chat or email). For more details on the third parties that may place cookies through the Website, please see the "Cookies" section below.
  • Changes in Business: If we are involved in a merger, acquisition, financing due diligence, reorganisation, bankruptcy, receivership, sale of all or a portion of our assets, or transition of a service to another provider, your Personal Data and other information may be transferred to a successor or affiliate as part of that transaction.
  • Legal Requirements: We will access and share account or other personal data when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity, or to prevent imminent harm to any person or to the property of Lingoswift, or to protect Lingoswift from legal liability. This will include accessing and sharing personal data with other companies, lawyers, or law enforcement.

We may share aggregate or anonymous data collected through the Service for purposes such as understanding or improving the service. An example of this would be displaying the number of users who are learning a certain language on Lingoswift.
Data Retention
You can update your account profile and some of your Personal Data by visiting your account page.
We will keep your Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so, or as required by law (e.g. for tax, legal, accounting or other purposes), whichever is the longer.

In line with the above, if you request that your data be deleted, we will delete the Personal Data that you provided, except for data that: (i) we are legally required to keep; (ii) is necessary to identify you (we will keep basic data to identify you and prevent further unwanted processing). Some Automatically collected user data may be kept anonymously to help us improve the service. User Content (as defined in our Terms) will not be deleted in line with our Terms.
Publicly Posted Information
This Privacy Policy shall not apply to any information you post to the public areas of the Services. This includes, but is not limited to, comments on the blog or public forums. Comments posted to public areas may be viewed, accessed, and used by third parties subject to those parties' privacy practices and policies.
Cookies
This Service uses "cookies" and similar technologies. A cookie is a small peice of data which is temporarily stored on a user's computer. Some cookies are necessary for the Service to function correctly. We use cookies to store your Session ID (this is used to confirm that a user is logged in).
Third parties such as Google may also store some cookies which aid in analytics as described under "Sharing and Third Parties" above.
If you do not want information to be stored or collected through the use of cookies, there is a simple procedure in most browsers that allows you to deny or accept the cookie feature; however, you should note that cookies may be necessary to provide you certain features available on the Service.
Security
We have implemented reasonable administrative and technical safeguards that we believe are appropriate to protect your Personal Data, User photo and login credentials from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet is 100% secure. Also, with sufficient resources, a determined attacker could defeat those safeguards and may, as a result, gain access to the data we seek to protect. Therefore, while we strive to protect your data, we cannot guarantee it's absolute security.
